Terms and Conditions
1. Qualifying Persons
1.1 Cyber Media ltd t/a wincars.club (the ‘Promoter’) operate skill/knowledge based competitions resulting in the allocation of prizes in accordance with these terms and conditions on the website www.wincars.club (‘Website’) – (the ‘Competition(s)’).
1.2 Competitions are open to everywhere in the world.

3.1 By entering a Competition the entrant (‘Entrant’, ‘you’, ‘your(s)’) will be deemed to have read and understood these terms and conditions and will be bound by them and by any other requirements set out in any related promotional material.
3.2 Competitions are governed by English Law and any matters relating to the Competition will be resolved under English Law and the Courts of England shall have exclusive jurisdiction.
4.1 Competitions may be entered via the Website. Multiple competitions may be operated simultaneously and each Competition will have a specific prize.
4.2 Availability and pricing of the Competitions are at the discretion of the Promoter and will be specified at the point of sale on the Website.
4.3 The Promoter is not responsible or liable in any way for the Valuation of the vehicle and makes no representation or warranty in respect of its accuracy.
4.4 Entry: Ticket Number(s) and the answer submitted to the Qualifying Question by the entrant.
4.5 Qualifying Question: The Question which Entrants must answer correctly (in substantial accordance with the answer held by the Promoter) to obtain an opportunity to win the Prize.
4.6 Minimum Number of Tickets: The Minimum Number of Tickets required in order for the car prize to be awarded, specified at the point of sale for each Competition.
4.7 Maximum Number of Tickets: The Maximum Number of Tickets available, specified at the point of sale for each Competition.
4.8 wincars.club account(s): When entering a Competition, entrants will need to provide an email address and password. Providing an entry was successful, an account will be created. Entrants can use this email address and password combination to login to their account on the website to view/place orders.
4.9 Once payment has cleared, Entrants will receive an email to confirm their entry into the Competition. Entrants should retain this email for their records and as proof of their ticket purchase(s).
4.10 The Promoter reserves the right to refuse or disqualify any Entries if it has reasonable grounds to believe that an Entrant has contravened any of these terms and conditions.
4.11 To the extent permitted by applicable law, all Entries become the property of the promoter and will not be returned/refunded.
4.12 There are no limits to the number of entries per person.
5.1 Each Competition runs for a specified period. Please see each Competition for details of start and end dates and times (‘Promotional Period(s)’).
5.2 The Promoter reserves the right, at its sole discretion, to extend the promotional period up to a maximum of six “6” months from the Competition start date, to enable more people to enter.
Closing the Competition
6.1 Provided that the Minimum Number of Tickets are sold, the draw for the prize will take place within 7 days of the specified Competition End Date, and will be streamed live on Facebook.
6.2 If the Number of Tickets sold does not reach the Minimum Number for the Competition by the specified end date, the Promoter reserves the right to either (a) as detailed in item (5.2) extend the promotional period up to a maximum period of six “6” months from the Competition Start Date or (b) close the Competition and award a cash prize (‘Prize Fund’) see item (7).
6.3 For the avoidance of doubt, the car prize will only be awarded to a winner if the Minimum Number of Tickets are sold at the Competition End Date.
The (‘Prize Fund’)
7.1 The (‘Prize Fund’) is the Cash Prize that will be paid to the winner in the event that the Number of Tickets sold does not reach the Minimum Number of Ticket Sales required by the specified Competition End Date.
7.2 If the promotional period is extended and runs for the maximum period of six “6” months and the Minimum Number of Ticket Sales is still not reached by the end date, the Cash Prize will be awarded to the winner of the Competition, instead of the car prize.
7.3 The Prize Fund that is paid to the winner of the Competition will be equivalent to 60% of the total ticket sales received prior to the Competition closing. The remaining 40% will be retained by the promoter to cover marketing costs, website costs and administrative expenditure.
7.4 For the avoidance of doubt, if the Prize Fund is paid to the winner, there will be no car prize.
8.1 The draw will take place within 7 days of the close of the competition.
8.2 The draw will be streamed live on the Promoters Facebook Page. All entrants to the competition will be notified of the date/time of the live draw by email.
8.3 The winner will be chosen at random using a Random Number Generator on www.random.org.
8.4 www.random.org is operated by Randomness and Integrity Services Ltd. The randomness comes from atmospheric noise, which for all relevant purposes is better than pseudo-random number algorithms typically used in computer programs.
8.5. In the event that a Number is drawn but the Entrant answered the Qualifying Question incorrectly, the Promoter reserves the right to void the ticket during the live draw, and randomly pick another Number. See item (8.3).
8.6 Due to the nature of the winning judgement there will only be one winner per competition.
8.7 The Promoter will attempt to contact Winner(s) using the telephone number(s) and email address(es) provided at the time of Entry (or as subsequently updated) and held securely in our database. It is the Entrant’s sole responsibility to check and update these details. If for any reason they are taken down incorrectly, the Promoter will not be held responsible. Entrants must carefully check their contact details have been recorded correctly.
8.8 If for any reason the Promoter is unable to contact the Winner within 30 days (which may be extended at the sole discretion of the Promoter) of a Competition ending or the Winner fails to confirm acceptance of the prize, the Winner will forfeit the prize, and the live draw will be repeated in order to find an alternative Winner.
8.9 All Entrants are automatically entered onto the Promoter’s database for the purpose of conveying information as to the status of their Competition, as well as any future Promotions or Competitions offered by the Promoter.
9.1 The Winner will be required to provide proof of identification, along with proof that the card used to purchase their tickets was legally theirs or proof that they were given permission to use it, before delivery/collection of a prize. Any failure to meet this obligation may result in the Winner being disqualified and the Facebook live draw being repeated to find an alternative winner.
9.2 Following receipt and verification of the details requested above by the Promoter, the Winner will be contacted in order to make arrangements for delivery/collection of the prize.
9.3 All Winners will also be required to provide photographs and/or pose for photographs and videos during collection/delivery, which may be used in future marketing and public relations by the Promoter in connection with the Competition and in identifying them as a winner of a Competition.
10.1 Prizes are selected by the Director(s) of Cyber Media ltd and are 100% owned by the promoter from the date of the competition going live on the website, to the date that the winner receives the prize. All car prizes are subject to a stringent background check to ensure that they are HPI clear i.e. free of finance, not stolen or written off etc. All prizes are available for immediate delivery. Details of each prize can be found on the website. The promoter takes no responsibility of the prize after the winner has taken delivery. No insurance is included and the promoter cannot be held responsible for the prize once handed over to the winner.
10.2 Delivery to the winner is free around the world. The promoter reserves the right to charge the winner for delivery if the winner requests for the prize to be delivered to Northern Ireland. Winners can opt to collect the prize free-of-charge instead of taking delivery.
10.3 Each Prize awarded must be accepted and is non-transferable.
10.4 The Promoter can store the prize free of charge for 30 days after notifying the First Prize Winner.
Winners’ Personal Data
11.1 Acceptance of the prize by the Winner will mean they are required to have their photo and video taken by the Promoter for promotional purposes (Public Relations and Marketing), both immediately after their win and in the future for use in accordance with rule (9.3), unless prohibited by law.
11.2 By entering a Competition, you agree to the use of your name, town/city, and photograph or other likeness without any additional compensation if you are declared a Winner.
Access to and use of the website
12.1 We endeavour to make our website accessible at all times. However, due to the nature of the Internet, this is not always possible. Access may be restricted due to third party problems, updating or maintenance of the website or due to factors not foreseen.
12.2 By emailing us, telephoning us with your email address or visiting our website, you consent to receiving electronic communications from us via email or notices posted on our website.
13. Security & Privacy
13.1 By registering with us and logging on to your account we undertake to keep your personal data secure in line with the Data Protection Act of 1998. All data you provide is transmitted and stored securely on our third party web-hosting server. This site does not retain your card details and they cannot be accessed through our site as they are never input or stored on it.
13.2 We take your privacy very seriously. We collect and use your personal information to provide you with details of recent product additions, special offers and important news/updates. We do not disclose your registered user details to third parties.
Ownership of content
All text, graphics, logos, images, software, digital downloads and audio files are the property of the promoter and may not be reproduced, duplicated, copied, sold, resold, or otherwise used for any commercial purpose without the written consent of the promoter.
Limits of Liability
The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize Winner(s) and, where applicable, to any family/persons accompanying the Winner(s), or in connection with any of the Competitions promoted by the Promoter.
No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet accessibility or availability or for traffic congestion or unauthorised human act, including any errors or mistakes. The Promoter shall use its best endeavours to award the prize for a Competition to the correct Entrant. If due to reasons of hardware, software or other computer related failure, or due to human error the prize is awarded incorrectly, the Promoter reserves the right to reclaim the Competition prize and award it to the correct Entrant, at its sole discretion and without admission of liability. The Promoter shall not be liable for any economic or other consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due. The Promoter shall use its best endeavours to ensure that the software and website(s) used to operate its Competitions perform correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. For the avoidance of doubt, only the ticket recorded in our systems, however displayed or calculated, shall be entered into the relevant Competition and the Promoter shall not be held liable for any competition entries that occur as a result of malfunctioning software or other event.
Data Protection Notice
Any personal data that you supply to the Promoter or authorise the Promoter to obtain from a third party, for example, a credit card company, will be used by the Promoter to administer the Competition and fulfil prizes where applicable. In order to process, record and use your personal data the Promoter may disclose it to (i) any credit card company whose name you give; (ii) any person to whom the Promoter proposes to transfer any of the Promoter’s rights and/or responsibilities under any agreement the Promoter may have with you; (iii) any person to whom the Promoter proposes to transfer its business or any part of it; (iv) comply with any legal or regulatory requirement of the Promoter in any country; and (v) prevent, detect or prosecute fraud and other crime. In order to process, use, record and disclose your personal data the Promoter may need to transfer such information outside the United Kingdom, in which event the Promoter is responsible for ensuring that your personal data continues to be adequately protected during the course of such transfer.
18.1 Each entrant should retain a copy of these Terms and Conditions for their future reference.
18.2 The Promoter reserves the right to amend these terms and conditions at any time and for any reason.
